Terms and Conditions for Brashan DNA Services

These Terms and Conditions (“Terms”) govern the relationship between Brashan DNA Services (“the Company”, “we”, “us”, or “our”) and the customer (“you”, “your”, or “the Client”) regarding the purchase and use of DNA testing services provided via brashandna.com (the “Website”). By ordering a test kit, booking a service, or otherwise using our services, you agree to be bound by these Terms.
1.1 Who we are. We provide DNA testing services to customers in the UK.
1.2 Service scope. Our services include (without limitation):
- Paternity and relationship testing
- Prenatal DNA testing
- Legal DNA testing
- Immigration DNA testing
- Baby gender testing
- Express and same-day result services (where available)
1.3 Peace-of-mind vs legal use. Some tests are provided for personal information only (“peace of mind”) and are not suitable for legal proceedings. If you need results for court, government, or official use, you must order a “Legal” test with Chain of Custody (see section 4).
1.4 Acceptance of these Terms. By placing an order or booking a service, you confirm that: (a) you have read and understood these Terms; (b) you are legally capable of entering into a binding contract; and (c) you will ensure the requirements in these Terms (including consent) are met before submitting any samples.
2.1 Placing orders. Orders are placed via the Website (brashandna.com). You should check your order carefully before submitting it.
2.2 Prices. All prices are displayed in GBP (£) unless stated otherwise. Prices may change from time to time, but changes will not affect orders already accepted by us.
2.3 What you’re buying. Depending on the service selected, your purchase may include (as applicable) a test kit, sample return materials, laboratory analysis, and reporting of results. Some services may also require an appointment with an independent sampler (for legal Chain of Custody) which may involve additional fees (see section 4).
2.4 Payment. Payment is taken at the time of ordering (unless we agree otherwise in writing). If payment is not received or is reversed/charged back, we may pause or cancel the order and/or withhold results until the issue is resolved.
2.5 Order acceptance. An order is accepted when we confirm it by email and/or dispatch the kit and/or begin arranging the service.
3.1 Criminal offence to test without consent. Under the Human Tissue Act 2004, it is a criminal offence in the United Kingdom to have human tissue with the intent of analysing its DNA without appropriate consent.
3.2 Your responsibility to obtain consent. You are solely responsible for ensuring that every participant whose sample is submitted (e.g., alleged father, mother, child, relatives) has provided informed, valid consent before any sample is collected, submitted, or tested.
3.3 Minors. Where a participant is a minor, consent must be provided in accordance with applicable law. Unless we confirm otherwise, for minors a person with parental responsibility must sign the consent documentation and arrange sample collection in line with our instructions.
3.4 Right to refuse/cancel testing. We reserve the right to refuse, pause, or cancel testing (and/or withhold results) if we reasonably suspect that valid consent has not been obtained or cannot be evidenced.
3.5 Indemnity. You agree to indemnify Dr Erada R. Oguntoye trading as Brashan DNA Services against claims, losses, liabilities, and expenses arising out of or in connection with any failure by you to obtain appropriate consent.
4.1 At‑Home (“peace of mind”) kits. At‑Home kits are intended for personal information only. Samples are self-collected (or collected by someone you arrange) following the instructions provided. At‑Home results are not legally admissible and must not be represented as such.
4.2 Legal kits (Chain of Custody required). If you require results to be used for court proceedings, official/legal disputes, or government matters (including immigration), you must order a Legal test. Legal tests require a documented Chain of Custody, typically including:
- Collection by a neutral, independent third-party sampler (e.g., doctor, nurse, trained professional sampler);
- Identity verification (ID checks) of each participant;
- Signed paperwork and tamper-evident handling; and
- Secure transfer of samples to the laboratory.
4.3 Booking a Legal test. You must tell us at the time of ordering/booking if you require a Legal test so we can arrange the correct process and documentation. If you submit samples as an At‑Home test and later request legal admissibility, this may not be possible and you may need to purchase a new Legal test.
4.4 Refusal of non-compliant samples. We may refuse to process samples submitted as “Legal” where Chain of Custody requirements are not met.
5.1 Dispatch times. We aim to dispatch kits within the timeframe shown at checkout or in the order confirmation email. Dispatch times are estimates and may vary due to stock, carrier delays, weather, or other events outside our control.
5.2 Delivery responsibility. Title and risk in delivered kits transfer to you upon delivery to the address provided (unless otherwise required by law). You are responsible for providing a correct delivery address and for securely storing kits upon delivery.
5.3 Discreet packaging. Kits are dispatched in discreet packaging where possible.
5.4 Using the kit correctly. It is your responsibility to follow the kit instructions exactly. Incorrect collection, contamination, insufficient samples, or use of expired/incorrect components may lead to delays, inconclusive results, or the need for recollection.
6.1 Laboratory standards. Testing is carried out using UK-based laboratories and processes designed to meet high quality standards. Where stated, testing is performed by an accredited UK laboratory.
6.2 Turnaround times. Turnaround times (including express or same-day services) are estimates provided at the time of purchase and typically run from the point the laboratory receives all required, correctly collected samples and documentation (including Chain of Custody documents for Legal tests). We are not responsible for delays caused by incomplete paperwork, missed appointments, postal delays, or the need for re-collection.
6.3 Same-day / express services. Same-day or express options may be subject to cut-off times, laboratory capacity, and receipt of suitable samples. Additional charges may apply and are typically non-refundable once the service has been scheduled or started (see Refund Policy).
6.4 Accuracy and limitations. While DNA testing is highly accurate, it remains a biological process and depends on the quality and identity of the samples submitted. Results are issued based on the samples received and the information provided.
6.5 Inconclusive or failed tests. Occasionally, a test may be inconclusive due to insufficient DNA, contamination, degradation, or other sample-related issues. In such circumstances: (a) no refund is payable where the inconclusive result is caused by poor sample quality, contamination, incorrect collection, or other issues outside our reasonable control; and (b) we may offer a re-test or recollection at our discretion (which may be free, discounted, or chargeable depending on circumstances).
7.1 Refund Policy. Cancellations and refunds are governed by our standalone Refund and Cancellation Policy shown below in this document and/or as published on the Website. If there is any conflict, the Refund and Cancellation Policy will apply to cancellations and refunds.
7.2 14-day cooling-off period. Where the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply, you may have a legal right to cancel within 14 days (cooling-off period), subject to the conditions and exclusions in the Refund and Cancellation Policy (including where services have begun and/or where kits have been dispatched/opened/used).
8.1 No legal advice. We do not provide legal advice. You are responsible for obtaining independent advice on how results may be used and interpreted for your circumstances.
8.2 Use of results. You acknowledge that results may have personal, emotional, financial, or legal consequences. You are responsible for how you use or disclose results.
8.3 Peace-of-mind tests. At‑Home (“peace of mind”) results are not intended for court or official use. We are not liable for any reliance on At‑Home results in any legal, administrative, or official context.
8.4 Exclusions. To the maximum extent permitted by law, we are not liable for: (a) indirect, incidental, special, or consequential losses; (b) loss of profits, income, business, or opportunity; (c) distress or emotional harm arising from results (to the extent legally excludable); or (d) losses arising from factors outside our reasonable control (including postal/courier delays, third-party sampler availability, or failure to follow instructions).
8.5 Liability cap. Subject to section 8.6, our total liability for any claim arising out of or in connection with a specific order shall not exceed the price paid for that specific testing service.
8.6 Non-excludable rights. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or your statutory consumer rights.
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Refund and Cancellation Policy
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of purchase (“the cooling-off period”), provided the service has not yet begun.
- Before Kit Shipment: If you cancel your order before the DNA testing kit has been dispatched, you will receive a full refund minus a £25 administration fee.
- After Kit Shipment (Unused): If the kit has already been dispatched, you must notify us within 14 days of receipt. The kit must be returned to us unopened, unused, and with the security seal intact. You will receive a refund minus a £40 fee to cover administration, kit production, and original shipping costs. You are responsible for the return postage costs.
No refunds shall be issued in the following circumstances:
- Once the laboratory has received your samples.
- Once laboratory testing has commenced.
- If the 14-day cancellation period has expired.
- If the testing kit has been opened, used, or tampered with.
- Express shipping, same-day service surcharges, or professional sampler fees.
To request a refund, please contact our support team at Csdna@brashandna.com with your order number. Approved refunds are processed within 14 to 28 business days and will be issued to the original payment method used at the time of purchase.
