When you are facing a situation that requires a legal paternity test, the stakes are naturally high. Whether you are dealing with a child maintenance dispute, an inheritance claim, or an immigration application, you need more than just a "yes" or "no" answer. You need a result that stands up in a court of law.

At Brashan DNA Services Limited, we understand that the process can feel overwhelming. The legal landscape regarding DNA testing in the UK is strict, designed to protect the rights of all parties involved: especially the child. To help you navigate this, we have compiled the seven essential things you must know before booking your test.

1. Consent is a strict legal requirement

In the UK, the Human Tissue Act 2004 makes it a criminal offense to possess or test a person's DNA without their valid consent. This is a critical distinction between "peace of mind" home tests and legal tests.

For a legal paternity test to be valid, written, informed consent must be provided by every adult being tested. Taking a sample from an adult without their permission: often referred to as "DNA theft": is punishable by up to 3 years in prison and a fine of up to £3,000.

What about children?

If the person being tested is under the age of 16, a person with Parental Responsibility (PR) must provide consent on their behalf.

  • The mother automatically has PR.
  • The father has PR if he is married to the mother or listed on the birth certificate (for births registered after certain dates in the UK).

Without the correct signatures from those with legal authority, the laboratory cannot and will not process the samples. You can review our privacy policy to see how we handle this sensitive data.

2. Only accredited laboratories are acceptable

You cannot use just any laboratory for a legal paternity test. If you intend to use the results for official purposes: such as changing a birth certificate or in a Family Court: the laboratory must be accredited by the United Kingdom Accreditation Service (UKAS) to ISO 17025 standards.

The Ministry of Justice maintains a list of laboratories accredited to carry out paternity tests directed by the civil courts in England and Wales. Using a non-accredited provider means your results will likely be inadmissible, leading to wasted time and money. Brashan DNA Services ensures that all legal testing is conducted through our accredited UK laboratory partner, providing you with results that are recognized by UK courts, the Home Office, and the General Register Office.

3. Samples must be collected by an independent third party

One of the most common questions we receive at Brashan DNA Services is whether you can collect the samples yourself at home. For a legal test, the answer is a firm no.

To ensure the integrity of the test, a strict "Chain of Custody" must be maintained. This means an independent, medically qualified third party must verify the identity of the individuals and collect the mouth swabs. This person is usually:

  • A General Practitioner (GP).
  • A registered nurse.
  • Anட் professional sampler from an accredited agency.

The sampler's role is to ensure that the person being tested is exactly who they claim to be, preventing any possibility of fraud or sample switching. If you are unsure how to arrange a sampler, you can reach out through our contact page for guidance.

4. A strict "Chain of Custody" must be maintained

The "Chain of Custody" is the chronological documentation or paper trail that records the sequence of custody, control, transfer, and analysis of the DNA samples. This process is what makes the test "legal."

How the process works:

  1. Identity Verification: The sampler checks the identification of all participants.
  2. Sample Collection: Swabs are taken and placed into sealed envelopes in the presence of the participants.
  3. Secure Transit: The sampler sends the samples directly to the laboratory. They must not be handed back to the participants to mail.
  4. Laboratory Receipt: The lab logs the arrival and checks that the seals are intact.

If this chain is broken at any point: for example, if a participant takes the samples home before posting them: the legal validity is instantly voided. We strongly advise following our procedural instructions to the letter to ensure your results are accepted by the relevant authorities.

5. Specific identification and photo requirements apply

Because the sampler must verify your identity, you cannot simply show up for your appointment. You must provide specific documentation to prove who you are. Generally, each participant will need:

  • Two identical passport-sized photographs: These must be recent, clear, and show the full face without any obstructions. The sampler will often sign the back of these photos to certify they are a true likeness of the person providing the sample.
  • Original Identification: A recognized form of UK government-issued ID, such as a valid passport or a full birth certificate.

For children who do not yet have a passport, a birth certificate is mandatory. Failure to bring these documents to the sampling appointment will result in the collection being cancelled, delaying your results and potentially incurring additional fees.

6. Legal tests are a private expense

It is a common misconception that paternity testing can be obtained for free through the NHS. However, DNA testing for legal or personal reasons is considered a private matter and is not funded by the health service.

You must pay for the test privately. While "peace of mind" kits found in our shop are more affordable, legal tests involve higher costs due to the administrative requirements, the involvement of professional samplers, and the accredited laboratory processes. On average, a legal paternity test in the UK starts around £289, though prices can vary based on the number of people being tested and the complexity of the case.

7. When exactly do you need a legal test?

If you are unsure whether you need a legal test or a standard home test, ask yourself: “Where is this piece of paper going?” If the answer involves any government body or legal entity, you need a legal test.

Key scenarios requiring legal DNA results:

  • Child Maintenance Service (CMS): To prove or disprove paternity for child support payments.
  • Birth Certificate Changes: If you wish to add or remove a father’s name from a birth certificate at the General Register Office.
  • Immigration Applications: When proving a biological relationship to the Home Office for a visa or citizenship. You can find more details on our immigration DNA testing page.
  • Probate and Inheritance: To claim an inheritance from a biological parent’s estate.
  • Family Court Proceedings: For custody or contact disputes where paternity is questioned.
